How Long Can I Live In My House After Foreclosure ?

When a home is being auctioned and the first sign of it is a foreclosure warning from the mortgage company. When a person defaults the payment for more than two months, then the mortgage company will send a letter requesting them to pay the dues or else they will have to appeal for a foreclosure. When the borrower does not respond with an answer, the foreclosure appeal is made to the court.

The entire foreclosure process may take up to six weeks and after which depending on the outcome there could be an auction planned. Typically, the court starts sending notices to the borrower to vacate the premises as soon as possible once it has been decided that there is going to be an auction held for the property. However, the borrower has time until the house is sold to someone else to stay in it. Also, the borrower has the right to stop the auction anytime until the house has been sold by making the pending payment. At that time may be the borrower will also need to pay the court charges and the expenses incurred due not the auction proceedings.

The borrower should appeal to the court when the foreclosure proceedings are taking place in order to retain the property. That is the best time to avoid a foreclosure. Usually, most lenders do make alternative arrangements or changes if the borrower is willing to clear he dues. Even the lenders do not generally favor an auction. For them, it is best when the borrower agrees to pay the dues.
